Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GameDevReady.com platform and services ("Service") provided by GameDevReady.com ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To use the Service, you must register for an account as an individual learner or be invited by an institutional administrator. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Upload or transmit malicious code, viruses, or any other harmful technology.
  • Scrape, crawl, or use automated means to access the Service without our written consent.
  • Reproduce, distribute, or create derivative works from our course content without authorization.
  • Share account credentials or allow unauthorized third parties to access the Service through your account.

3. Institutional Accounts

If you access the Service through an institution (your school, employer, or another entity that has purchased an institutional license), your institution's administrator may control certain aspects of your account, including the ability to view your training progress, manage your enrollments, and restrict or terminate your access. Your use of the Service is also subject to any agreements between your institution and GameDevReady.com.

4. Purchases and Billing

Individual Pricing

Individual courses and certification bundles are offered at the prices described on our pricing page. Prices are subject to change with 30 days' notice. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.

Institutional Licensing

Institutional licenses are governed by separate agreements. Contact us for institutional pricing and terms.

Payment

Payment is processed through Stripe. By providing payment information, you authorize us to charge the applicable fees. You are responsible for providing accurate billing information and ensuring your payment method is current.

5. Intellectual Property

Our Content

The Service, including all course content, software, design, text, graphics, and other materials, is owned by GameDevReady.com or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Your Content

You retain ownership of any content you submit to the Service (such as Capstone project submissions, profile information, and form submissions). By submitting content, you grant us a limited license to use, process, and store that content as necessary to provide the Service.

6. Certification and Credentials

The GameDev Ready™ credential issued through the Service represents that a learner has completed the specified courses and passed the certification exam. Credentials are verifiable through our public verification portal. Credentials are valid for the period specified at the time of issuance and may require recertification.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Our training content is designed for educational and professional development purposes. Completion of courses and certification does not guarantee employment or specific career outcomes.

9. Limitation of Liability

To the maximum extent permitted by applicable law, GameDevReady.com and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you or your institution paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless GameDevReady.com from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall continue in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. If you continue to use the Service after changes take effect, you agree to the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
